Authorities suspected that Rosemelyn Recote was gunned down in order to silence her.
Recote, a first year college working student had filed seven cases in 2009 against Enrique Losaynon which are pending at the Regional Trial Court Branch 33 under Judge Lope L. Callo.
She was gunned down by two unidentified men while riding a jeepney along Coca- Cola Village and Mac Arthur Highway.
Atty. Jackielyn Garcia, Clerk of Court of Branch 33 told MindaNews the cases were scheduled for hearing on February 15. The six cases which allegedly happened last December 2009 were set for arraignment while the seventh was set for preliminary hearing.
“Maghulat pa me sa decision ni Judge sa ana nga kaso kay estadihan pa man na niya (We’re still waiting for the judge’s decision because he has to study the cases first),” Garcia said.
A legal researcher at RTC Branch 15 said that even if a complainant is already dead, a case may still continue if the prosecution can present witnesses.
The accused is still detained at the city jail.
Rape is a non-bailable offense.
The alleged rape happened when Recote was still seventeen years old. She was under the care of Bahay Dangupan for her protection and availed of a scholarship from the government.[]
